Terms of Service

1. Acceptance of Terms

By accessing or using the Eatpace application ("the App") or website ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Eatpace.

Eatpace is operated by ShopEms, registered in the Netherlands (KVK 89061225). References to "Eatpace", "we", "us", or "our" refer to ShopEms.

2. Service Description

Eatpace is an automatic weekly meal-planning service. We provide:

  • Personalised weekly dinner plans based on your preferences
  • Automated shopping lists derived from your meal plan
  • A recipe library for browsing and inspiration
  • Saved recipes for future reference

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice for material changes.

3. Guest Mode and Account Registration

You may use certain features of Eatpace in guest mode without creating an account. Guest mode data is stored locally on your device.

To access additional features (syncing across devices, household sharing, premium features), you must create an account. When you register, you agree to:

  • Provide accurate and complete information
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity under your account

4. Subscriptions and Payments

Eatpace offers both free and premium features. Premium features require a paid subscription.

Billing

  • Subscriptions are billed through Apple (App Store) or Google (Google Play), depending on your device
  • Payment is processed by the respective platform — Eatpace does not store or handle your payment card details
  • Subscription management is facilitated by RevenueCat, which processes your user ID and purchase status to manage entitlements. See RevenueCat's Privacy Policy
  • Subscription prices are displayed in the App before purchase and may vary by region

Auto-Renewal

  • Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on your plan) unless you cancel before the renewal date
  • Your Apple ID or Google account will be charged for renewal within 24 hours before the end of the current period
  • You can turn off auto-renewal at any time through your device's subscription settings

Free Trials

  • If a free trial is offered, it will be clearly stated with its duration before you subscribe
  • Unused portions of a free trial are forfeited when you purchase a subscription
  • You will be charged automatically at the end of the trial unless you cancel before the trial expires

Cancellation and Refunds

  • You may cancel your subscription at any time through your device's subscription settings (Apple: Settings > Apple ID > Subscriptions; Google: Play Store > Subscriptions)
  • Cancellation takes effect at the end of your current billing period — you retain access until then
  • Refunds are handled by Apple or Google in accordance with their respective refund policies
  • We do not process refunds directly — please contact Apple Support or Google Play Support

5. User Content

Your dietary preferences, saved recipes, and feedback ("User Content") remain your property. By using Eatpace, you grant us a limited, non-exclusive licence to use your User Content solely for the purpose of providing and improving the service.

We may use anonymised, aggregated data (which does not identify you) to improve our recipes and meal-planning algorithms.

6. Intellectual Property

All content, software, designs, recipes, and branding on Eatpace are the intellectual property of ShopEms or our licensors. You may not:

  • Copy, modify, or distribute our recipes, content, or software
  • Reverse-engineer, decompile, or disassemble the App
  • Use our trademarks, logos, or branding without written permission
  • Scrape, crawl, or systematically extract content from the Website or App

You may share individual recipes for personal, non-commercial purposes using the share features provided in the App.

7. Health and Dietary Disclaimer

Eatpace is not a medical, nutritional, or health service. Our meal plans and recipes are provided for convenience and inspiration only.

  • Eatpace does not provide medical or dietary advice
  • Recipes may contain allergens, even when dietary filters are applied — always verify ingredient labels
  • Nutritional information (where displayed) is estimated and may not be accurate
  • If you have food allergies, intolerances, or medical dietary requirements, consult a qualified healthcare professional
  • We are not liable for any allergic reactions, adverse health effects, or dietary issues arising from the use of our recipes or meal plans

You acknowledge that you are solely responsible for verifying that recipes and ingredients are safe and suitable for you and anyone you cook for.

8. Prohibited Use

You agree not to:

  • Use Eatpace for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the service or servers
  • Upload malicious code, viruses, or harmful content
  • Use automated tools (bots, scrapers) to access the service without permission
  • Impersonate another person or entity
  • Use the service to distribute spam, unsolicited messages, or advertising

9. Limitation of Liability

To the maximum extent permitted by Dutch and EU law:

  • Eatpace is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not guarantee that the service will be uninterrupted, error-free, or secure
  • Our total liability for any claim arising from your use of Eatpace is limited to the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater
  • We are not liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profit

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

10. Termination and Account Deletion

You may stop using Eatpace at any time. You can delete your account from the App settings or by contacting us at legal@eatpace.com.

We may suspend or terminate your account if you violate these Terms, with notice where reasonably possible. Upon termination:

  • Your right to use the service ceases immediately
  • Your data is deleted in accordance with our Privacy Policy
  • Active subscriptions must be cancelled separately through Apple or Google

11. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Dordrecht, the Netherlands.

If you are a consumer in the EU, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform. This does not affect your right to bring proceedings in the courts of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or email at least 30 days before the changes take effect. Your continued use of Eatpace after the effective date constitutes acceptance of the updated Terms.
